Mods Nation User Agreement

Effective: August 10, 2026

This Agreement is between you and MISTY ISLANDS LTD CO, a Georgia limited liability company ("Mods Nation," "we," "us"), and governs your use of modsnation.com and everything we offer through it. By using Mods Nation you accept this Agreement. If you do not accept it, do not use the platform.

Our Privacy Policy, Community Guidelines, Terms of Sale, and DMCA Policy are part of this Agreement.

1. Eligibility

You must be at least 16 years old. By using Mods Nation you represent that you are, and that nothing prevents you from entering into this Agreement.

2. Your account

Sign-in is through Google. You are responsible for everything done through your account, for keeping access to it secure, and for telling us at support@modsnation.com if you believe it has been compromised. One person, one account. Do not share it, sell it, or transfer it.

3. What we license to you

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to view and use the platform for your own non-commercial purposes, subject to this Agreement. That is all we grant. Everything not expressly granted is reserved.

Platform Content means everything made available on or through Mods Nation, whoever created it and whether or not it is behind a sign-in: our 3D models, textures, parts and vehicle data, imagery, software and the configurator; auction, market, pricing and fitment data; shop and event listings; and everything members publish — builds and build configurations, photographs, decals, journals, articles, comments, listings, and renders. New features are covered as soon as they exist, without needing to be named here.

You may not, without our prior written permission:

• copy, scrape, crawl, index, harvest, mirror, cache beyond ordinary browsing, or otherwise extract Platform Content, in whole or in part, by any means, manual or automated;
• access the platform through any automated system, bot, script, headless browser, or undisclosed integration, or in any way other than the interfaces we provide;
• assemble, derive, or distribute any dataset, catalog, index, price guide, or database from Platform Content;
• use Platform Content to train, fine-tune, evaluate, or otherwise develop any machine learning or artificial intelligence model or system;
• reverse-engineer, decompile, disassemble, or attempt to extract our 3D models, textures, source code, or the configurator;
• remove, obscure, or bypass any watermark, attribution, technical protection, rate limit, paywall, or access control;
• collect or compile information about members, including names, avatars, activity, or contact details;
• use the platform to build or improve a competing product, dataset, or service, or to benchmark it for that purpose;
• resell, sublicense, rent, or redistribute any part of the platform or Platform Content.

Search engines. Public search engines may crawl and index public pages to the extent our robots.txt allows, solely to link people back to us. That permission does not extend to storing, republishing, or reusing Platform Content beyond ordinary search indexing, and does not permit use for model training.

These restrictions apply to publicly accessible pages as well as to signed-in areas, and apply regardless of whether the content was created by us or by another member. Members grant us the license in Section 5.3, and nothing in that license gives anyone else a right to take their content.

4. Rules of conduct

Our Community Guidelines set out what is and is not acceptable. They form part of this Agreement, we may change them, and breaking them can cost you your content, a feature, or your account.

5. Your content

5.1 What counts. Photographs, images used as decals or logos, articles, journal entries, comments, messages, listings, events, build configurations, and 3D models you submit.

5.2 Ownership. You keep whatever rights you have in what you submit. We claim no ownership.

5.3 License you give us. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, publish, translate, distribute, and display your content in connection with operating and promoting the platform. This license lasts as long as your content is on the platform, and survives afterwards to the extent needed for backups, records, and copies others have already made.

5.4 Published 3D models. When you publish a 3D model, the license in 5.3 is irrevocable and perpetual as to that model, because other members build on published models and those builds cannot be unwound. Deleting your account does not revoke it. This does not apply to a model removed because you had no right to publish it.

5.5 Feedback. Anything you send us as a suggestion, idea, or feature request is ours to use freely, with no obligation and no compensation.

5.6 Your promises. You represent that you own or are licensed to submit everything you upload, that it does not infringe anyone's rights, and that it does not break any law. You are responsible for it, and you keep that responsibility after you delete it.

5.7 What we may do. We may remove, restrict, refuse, or reorder any content, at any time, at our discretion, with or without reason and with or without notice. We do not pre-screen content and have no obligation to monitor it. Nothing here obliges us to store your content or to keep it available.

6. Our content

The platform, its software, the configurator, our 3D models, parts data, imagery, text, design, and trademarks are ours or licensed to us, and are protected by law. Our catalog models are not user content and are not subject to the takedown procedure in our DMCA Policy.

6.1 Brands and trademarks

Mods Nation is an independent platform. It is not sponsored by, associated with, approved by, endorsed by, or in any way affiliated with any automobile manufacturer, parts manufacturer, or brand.

All trademarks, registered or unregistered — including names, logos, model designations, images, and the distinctive shapes of products and vehicles — are the property of their respective owners. Any mention or depiction of such marks on Mods Nation is made strictly to identify the products and vehicles they belong to, so that members can find parts and see how a combination would look on their own vehicle. We claim no rights in these marks, and their appearance here implies no relationship, sponsorship, or endorsement by their owners.

Ratings, polls, and popularity features on Mods Nation reflect what our community chooses and how often. They are not endorsements by any brand, and they are not statements by us about the quality, safety, or fitness of any product.

Nothing in this Agreement gives you any right to use any third-party mark. You may not use a brand's name, logo, or imagery on Mods Nation except where the platform itself provides it for identifying a product, and never in a way that suggests you represent or are endorsed by that brand.

7. Paid features

Subscriptions and MODS are governed by our Terms of Sale. In summary: subscriptions renew monthly until cancelled, the monthly allowance of MODS expires at the end of each cycle, MODS are a license to use paid features and never money, and charges are non-refundable except where law requires otherwise.

We may change, limit, or discontinue any paid feature. If we discontinue one entirely, we will say what happens to affected subscriptions.

8. AI renders

Renders are produced by us from our catalog models at your request, using third-party image generation. See our Privacy Policy for what is processed.

8.1 Inputs are yours to answer for. You are responsible for every image you supply as an input. Do not supply anything you do not have the right to use, and do not supply images of other people without their agreement. Your indemnity in Section 13 applies to inputs in full.

8.2 What you get. We grant you the right to use the renders you generate for personal and non-commercial purposes. Renders depict our catalog models; nothing in this section transfers rights in those models, and nothing gives you rights in any brand shown.

8.3 No guarantee of result. Generation is probabilistic. Output varies, may not match your expectations, and may contain errors or artifacts. A result you dislike is not a defect, and Section 7 governs whether MODS are returned.

8.4 No misuse. Do not use renders to misrepresent a vehicle's condition, damage, specification, or existence, in a listing or anywhere else.

9. Marketplace and listings

Listings connect members with each other. We are not a party to any transaction, do not take payment between members, do not hold funds, do not verify what is offered, and do not guarantee any sale. Any dispute about a transaction is between the buyer and the seller.

If you list, you are responsible for the accuracy of your listing and for complying with every law that applies to the sale, including disclosure of title status, damage, and mileage. You are responsible for your own taxes.

Some vehicle listings originate from public sources rather than from a member. Those are marked, and a person who can show they own the vehicle may claim the listing.

10. Auction and market data

We display and analyze data from public vehicle auction sources. Bidding does not take place on Mods Nation, and we are not an auction house, broker, dealer, or agent. This data is informational, may be inaccurate, incomplete, or out of date, and is not an appraisal, a valuation, or advice. Do not rely on it for a purchase decision.

11. Third-party services

Video. Video features use YouTube's embedded player and API Services. Your use of them is also governed by the YouTube Terms of Service.

Radio. Station streams come from third parties and play from their servers. We do not host, rebroadcast, or control them, and we are not responsible for their content or availability.

Links and affiliates. Links leave our platform and we are not responsible for what is on the other side. We may earn commission on qualifying purchases, which does not change your price.

12. Disclaimers

12.1 As is. The platform is provided "as is" and "as available," without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the platform will be uninterrupted, secure, or error-free, or that any content is accurate.

12.2 No accuracy guarantee. Parts data, fitment, compatibility, pricing, availability, specifications, auction data, and member content may be wrong. Verify anything that matters before you rely on it.

12.3 Vehicle safety and legality. Mods Nation is a visualization and community platform, not an engineering, inspection, or advisory service. Nothing here is professional advice. Modifications affect safety, reliability, insurance, warranty, emissions compliance, and legality, and rules differ by jurisdiction. You are solely responsible for deciding whether a modification is safe and lawful where you are, and for having work done by qualified people. We disclaim all liability for injury, death, property damage, loss, fines, or legal consequences arising from any modification, part, or decision informed by the platform.

12.4 Members. We do not vet members, shops, businesses, or manufacturers, and we are not responsible for their conduct, on or off the platform.

13. Indemnity

You will defend, indemnify, and hold harmless MISTY ISLANDS LTD CO, its officers, employees, and agents from any claim, demand, loss, liability, damage, fine, cost, or expense, including reasonable legal fees, arising from: your content, including render inputs; your use of the platform; your breach of this Agreement or of law; your transactions with other members; and any claim that your content infringes someone's rights. We may take over the defense of any such claim at your expense, and you will not settle anything affecting us without our written consent.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, however caused and on any theory of liability, even if we were told such damages were possible.

Our total liability for all claims relating to the platform is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you; in that case our liability is limited to the smallest extent that jurisdiction permits.

15. Suspension and termination

15.1 By you. Delete your account in settings at any time. Cancel any subscription first; deleting an account does not cancel billing.

15.2 By us. We may suspend, restrict, place in read-only mode, or terminate your account and remove your content at any time, at our discretion, with or without notice, including for breach of this Agreement or the Community Guidelines, for suspected fraud or abuse, for repeated infringement claims, or where we consider it necessary to protect the platform or other members.

15.3 Effect. On termination your license under Section 3 ends immediately, access to paid features ends, remaining MODS expire, and no refund is due. Sections 5.3, 5.4, 5.6, 6, 12, 13, 14, 16, 17, and 18 survive.

16. Disputes

16.1 Individual claims only. You and we agree that any dispute will be brought only on an individual basis. You waive any right to bring or participate in a class, collective, consolidated, or representative action. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court, and this section otherwise remains in force.

16.2 Governing law and forum. This Agreement is governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. You consent to the exclusive jurisdiction of the state and federal courts in Gwinnett County, Georgia. Intellectual property matters are governed by applicable federal law.

16.3 Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent law permits such a limit.

16.4 Injunctive relief. Nothing prevents either party from seeking an injunction to protect intellectual property or to stop unauthorized access.

17. Changes to this Agreement

We may change this Agreement. We will update the effective date and, for material changes, give notice by email or on the platform. Continued use after a change takes effect is acceptance. If you do not accept, stop using the platform and delete your account.

18. General

Entire agreement. This Agreement and the documents it incorporates are the whole agreement between us and replace anything said before.

Severability. If a provision is unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force.

No waiver. If we do not enforce something, that is not a waiver of it.

Assignment. You may not assign this Agreement. We may, including in a merger, acquisition, or sale of assets.

Force majeure. We are not liable for failure or delay caused by anything outside our reasonable control.

Export and sanctions. You may not use the platform if you are subject to applicable sanctions or located in an embargoed jurisdiction, and you may not use it in violation of export control law.

Notices. We may give notice by email to the address on your account, or by posting on the platform. Notices to us go to support@modsnation.com.

No agency. Nothing here creates a partnership, employment, agency, or joint venture between us.

Language. The English version controls.
